Terms, Conditions & Policies

By enrolling yourself (in the case of adult students) or your child (in the case of students under 18 years of age) at Rain & Lucky Academy of Dance (R&L) classes you (as the adult student, or the child student’s parent or guardian) acknowledge that you have read, agree to abide by, and (where the context requires) consent to, all of the terms, conditions, codes and policies referred to below.

 

Rain & Lucky Handbook

A comprehensive digital ‘Handbook’ is provided to all students/families upon enrolment at Rain & Lucky Academy of Dance. This contains further information regarding the structure and expectations associated with enrolment at Rain & Lucky, and forms part of these Terms, Conditions & Policies. 

 

Payment Policy

The credit card that you have registered on your Rain & Lucky account will be charged the amount due on your account on the 1st of each month, from February to December only.

Direct debit is the same amount each month regardless of how many classes are in the month. This includes school holidays, since the payments are averaged out over the full year.

Direct debits to your account will continue until December of the year you selected classes, otherwise notified in writing to hello@rainandlucky.com.

One month’s written notice is required to cancel membership or reduce your number of weekly classes. Your next month’s tuition will be processed if notice is received after the 10th of the month. 

If a payment bounces, we will try again to process the payment. Late fees may be charged. Continued failed payments may result in you/your child being unable to take class.

All fees are strictly non-refundable.

No refunds or credits are given for classes missed.

If government-imposed restrictions or other related circumstances outside of our control require us to close our doors, we will revert to online learning. There will be no refunds or credits towards future fees for absences and/or if government restrictions require us to stop face-to-face learning.

Security and Surveillance

For the safety and security of all our students, staff, families, studio hirers, guests, and of our premises, CCTV cameras are installed at Rain & Lucky Fairfield and Preston, in the locations of:

  • Dance studios
  • Main foyers/waiting room
  • Front doors

Footage is recorded and may be saved for future reference in the event of an incident. 

Rain & Lucky front doors are accessible with a security code which is provided to families and hirers. For the safety of all studio users, this code must never be shared with the public.

 

Social Media, Image & Video Policy

Images and video from classes, performances and various events will be used to promote the activities of Rain & Lucky Academy of Dance, e.g. in newsletters, on the website, social media (e.g. Facebook/Instagram), noticeboards, brochures and so on. Parents consent to the use of images/video of their children in this way, and waive all rights in respect of such images/video – unless opting out in writing. Upon enrolment you will be given an opportunity to opt out.Rain & Lucky Academy of Dance will not sell the images/videos to third parties.

Parents are not permitted to take images/video of their children during Rain & Lucky classes, concerts or events. This is part of our Child Safety Policy (to protect other children who may be in the images/video) and to respect the privacy of our staff.

From time to time, exceptions may be made, at the discretion of Rain & Lucky staff. In these situations, parents consent to other parents taking images/video of their children. Parents must use all such images/video appropriately. Rain & Lucky takes no responsibility or liability in relation to the use of images/video by parents.

Rain & Lucky holds a dedicated Photo Day every year, which is optional for all students to attend. These photos are made available for families to purchase directly from the photographer.

Rain & Lucky may have photographers/videographers present at various events, and the resulting images will be provided to families where they are part of the advertised fees package.

 

Medical Treatment & Injury

Dance/Drama are physical activities and whilst all reasonable care is taken, to the extent permitted by law Rain & Lucky Academy of Dance is not liable for injuries sustained during classes, instruction, performance activities or otherwise.

In the case of an injury or health concern in respect of your child, all reasonable efforts will be made to contact you promptly. But, in the case of an emergency, or in the event that you cannot be reached, R&L will seek medical attention for the student. This may involve R&L rendering first aid to the student or calling an ambulance for the student. You agree to indemnify R&L for any costs incurred in obtaining such emergency medical attention, for example ambulance fees.

It is the responsbility of the parent/guardian to provide Rain & Lucky with an medical information that may affect the child while at Rain & Lucky.

 

Failure to Comply With These Terms, Conditions & Policies

In the event of any failure to comply with any of the terms, conditions, codes or policies referred to on this page, Rain & Lucky reserves the right to cancel the student’s enrolment and in this situation any fees paid or payable will not be refunded.

 

Rain & Lucky Academy of Dance is located on the traditional lands of the Wurundjeri, Woi-wurrung people. We acknowledge the traditional owners of the land and pay our respects to Elders past, present and emerging.
